Health Coaching Program – Release and Waiver of Liability

This Release and Waiver of Liability (“Agreement”) is entered into by and between the undersigned client (“Client”) and Ann Hackman, dba Restore Health Coaching, a health and wellness coaching business based in the State of North Carolina.

By participating in this program, you agree to the following terms:

1. Voluntary Participation

I understand that my participation in the health coaching program (“Program”) is entirely voluntary. I affirm that I am physically and mentally able to participate in this program and understand that I am responsible for my own health and well-being throughout.

2. Nature of Health Coaching

I understand that health coaching is not a substitute for medical advice, diagnosis, or treatment. The Program does not include the practice of medicine, nutrition therapy, or psychological counseling. I agree to consult with my physician or qualified healthcare provider regarding any medical concerns before making any changes to my diet, exercise, medications, or lifestyle.

3. Assumption of Risk

I understand that there are inherent risks associated with any health or wellness program, including but not limited to changes in physical or emotional well-being, injury, or adverse reactions. I voluntarily assume full responsibility for any risks, injuries, or damages, known or unknown, which I might incur as a result of participating in the Program.

4. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Ann Hackman, Restore Health Coaching, its employees, independent contractors, affiliates, and representatives from any and all claims, liabilities, damages, or expenses arising out of or related to my participation in the Program.

5. No Guarantees

I understand that individual outcomes from participation in the Program may vary and that no specific results or outcomes are guaranteed. My success depends on my individual effort, commitment, and follow-through.

6. Confidentiality

All personal information shared in the Program will be kept confidential in accordance with applicable privacy laws. However, I acknowledge that the Program is not governed by HIPAA.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved in the state or federal courts located in North Carolina.

8. Severability

If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

9. Entire Agreement

This Agreement represents the entire understanding between the parties and supersedes all prior discussions or agreements, whether written or oral, regarding the Program.

Acknowledgment

By participating in this Program or checking the agreement box on the form or checkout page, you acknowledge that you have read, understood, and voluntarily agree to the terms of this Release and Waiver of Liability.
